Обзор Постановления пленума по ОСАГО 2015 года
В январе 2015 года Пленум Верховного суда РФ разместил на своем официальном сайте Постановление об автостраховании, в котором рассмотрел 66 вопросов по ОСАГО. Самые важные изменения рассмотрим ниже:
В случае отказа страховщика выплатить страховое возмещение претензия подается с момента получения отказа.
Исковая давность начинает течь с момента получения данного отказа (либо с момента, когда потерпевший должен был получить информацию об отказе).
Страховой случай по ОСАГО не обязательно наступает при движении автомобиля. ДТП при буксировке, стоянке и т.д. тоже подходит под определение страхового случая.
В случае прямого возмещения ущерба учитывается износ деталей автомобиля, и недостающую для ремонта сумму компенсирует потерпевший.
Новые страховые суммы применяются только относительно договоров, заключенных после 01.10.2014 г.
По договорам, заключенным после 1.04.2015 г размер страхового возмещения может достигать 500 000 рублей (в случае причинения вреда жизни или здоровью).
В случае полной гибели автомобиля размер выплаты определяется его действительной стоимостью на день наступления страхового случая за вычетом годных остатков с учетом их износа.
Размер неустойки за несоблюдение сроков осуществления страхового возмещения равен 1 проценту за каждый день просрочки.
