Основания для регрессного иска – изменение ОСАГО №5

Далеко не все водители, приобретающие полис ОСАГО, осознают, что их же страховая компания может потребовать от них возмещения ущерба, причиненного ими в результате ДТП. То есть, имея на руках страховку, многие ошибочно считают, что, даже если авария произошла по их вине, они никому ничего не должны, вся ответственность лежит на страховщике. Поэтому очень важно знать некоторые тонкости механизмов страховых выплат, которые дают страховой компании основания потребовать с Вас возмещения убытков.

Суть регресса такова: страховщик возмещает ущерб, а затем взыскивает выплаченную сумму с виновника аварии.

Однако это, разумеется, не значит, что, если Вы являетесь виновником ДТП, обязательно запускается процесс регресса. Тогда наличие у Вас полиса ОСАГО было бы бессмысленным.

Давайте рассмотрим конкретно те случаи, которые влекут за собой привлечение водителя к возмещению убытков. Вы отвечаете за причиненный вред при следующих условиях:

    • Вы умышленно причинили вред жизни или здоровью потерпевшего.

    • Вы управляли ТС в состоянии опьянения.

    • Вы не имели права на управление данным ТС.

    • Вы самовольно покинули место происшествия.

    • Вы не были вписаны в договор ОСАГО.

    • Вы оформили ДТП без участия сотрудника ГАИ и после этого не направили в Вашу страховую компанию экземпляр "Европротокола" в течение 5 рабочих дней.

    • Вы приступили к ремонту Вашего ТС в течение 15 календарных дней со дня ДТП или не предоставили данное ТС для осмотра по требованию Вашего страховщика (в случае самостоятельного оформления ДТП).

    • Истек срок действия Вашей диагностической карты.

Следовательно, требовать с Вас возмещения убытков возможно только при совершении противозаконных действий с Вашей стороны. Поэтому, садясь за руль, будьте внимательны и не нарушайте закон!
